Terms of Service

1. Agreement

By creating an account or using BubbaChat (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms are governed by the laws of Queensland, Australia.

2. Who may use the Service

You must be:

• At least 18 years old (or the age of majority in your jurisdiction), and
• A human individual (not a bot or automated account)

You may not use the Service on behalf of another person unless you are their parent or legal guardian.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at joel@logix26.com if you suspect unauthorised access to your account.

4. Acceptable use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms.

5. Content you post

You own your content. By uploading photos, videos, or other content to BubbaChat, you grant us a limited, non-exclusive, royalty-free licence to store, process, and deliver that content solely for the purpose of providing the Service to you and the members you authorise. We do not claim ownership of your content and do not use your photos or videos for any purpose other than delivering the Service.

You are responsible for your content. You represent that:

• You own or have the right to upload any content you post
• Your content does not infringe any third party's copyright, privacy, or other rights
• You have consent from parents/guardians for any photos of children that are not your own

6. Subscriptions and billing

6.1 Plans

Prices are in Australian dollars (AUD) and include GST where applicable.

6.2 Free trial

Paid plans include a 14-day free trial. You will not be charged until the trial ends. You may cancel before the trial ends and will not be charged.

6.3 Billing

Subscriptions are billed in advance on a monthly or annual cycle via Stripe. Your subscription automatically renews unless you cancel before the next billing date.

6.4 Cancellation

You may cancel your subscription at any time through the subscription management portal in the app. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.

6.5 Refunds

Under the Australian Consumer Law (ACL), if the Service fails to meet a consumer guarantee, you may be entitled to a remedy. Outside of ACL rights, subscription fees are non-refundable for the current billing period once the free trial has ended. If you believe you are entitled to a refund under the ACL, contact joel@logix26.com.

6.6 Plan downgrades

If you downgrade your plan and your account exceeds the new plan's limits, your additional babies will be hidden, not deleted, until you upgrade again or archive them.

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law. Our Services come with consumer guarantees that cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any loss or damage caused by events outside our reasonable control
• Our total aggregate liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages

These limitations do not affect any rights you have under the ACL that cannot be limited.

10. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We will use reasonable endeavours to notify you in advance of scheduled maintenance.

11. Intellectual property

All intellectual property in the BubbaChat software, design, and brand belongs to LOGIX 26 PTY LTD. You may not copy, reproduce, or distribute any part of the Service without our written permission.

12. Termination

We may suspend or terminate your account if you breach these Terms or our Acceptable Use Policy. We will give you notice where reasonably practicable before termination, unless the breach involves illegal content or immediate harm.

You may delete your account at any time via the app. Deleting your account will permanently remove your data (subject to the retention periods in our Privacy Policy).

13. Changes to these Terms

We will notify you of material changes to these Terms via email or in-app notification at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.

14. Governing law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
