Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) sets out what content and behaviour is permitted on BubbaChat. It applies to all content you upload, post, comment, or share through the Service. This AUP is incorporated into and forms part of our Terms of Service.

2. What is permitted

BubbaChat is a private, family-focused platform for sharing photos, videos, and memories of babies and children with invited family and friends. Permitted uses include:

Sharing genuine photos and videos of your children with family and close friends
Posting milestones, updates, and memories about your baby
Commenting on and liking posts shared with you
Inviting family members via share codes

3. Prohibited content

You must not upload, post, or share content that:

3.1 Child safety

Constitutes child sexual abuse material (CSAM), which is strictly prohibited under Australian and international law. We will report all suspected CSAM to the Australian Centre to Counter Child Exploitation (ACCCE) and the relevant law enforcement agency without notice. See our CSAM reporting section and the ops runbook referenced there.
Sexualises minors in any way
Could be used to identify, locate, or contact a child without parental authorisation

3.2 Illegal content

Infringes any person's copyright, trade mark, or other intellectual property rights
Contains material that is defamatory, harassing, or that constitutes a threat
Violates any applicable Australian or international law
Is obtained in breach of another person's privacy

3.3 Harmful content

Depicts child abuse, neglect, or endangerment
Contains graphic violence, gore, or disturbing imagery
Is intended to bully, harass, or intimidate any person (including other members)

3.4 Deceptive or disruptive content

Impersonates another person or organisation
Distributes malware, spam, or phishing content
Circumvents or attempts to circumvent the Service's access controls

4. Prohibited behaviour

You must not:

Share your account credentials or share codes with persons who are not genuine family or friends of the baby
Attempt to access another user's content without authorisation
Use the Service for commercial purposes (advertising, selling products, spam)
Attempt to reverse-engineer, scrape, or automate access to the Service
Exceed the storage or baby limits of your subscription plan through artificial means

5. Reporting content

All BubbaChat members can report any post by tapping the report button. Reported content is reviewed by our moderation team. We aim to review reports within 72 hours.

The owner of a baby profile (with the perm_can_revoke permission) may also revoke access for any member who violates this AUP.

6. Our response to violations

When we identify or receive a report of content that may violate this AUP, we may:

Remove the content
Restrict or suspend the offending account
Notify affected members where appropriate
Report the content to law enforcement where required by law (including CSAM to the ACCCE)

We will not disclose personally identifying information in violation reports except where required by law.

7. Child safety and CSAM reporting

Legal obligations

Under the Criminal Code Act 1995 (Cth) §§474.19 to 474.26 and the Online Safety Act 2021 (Cth), BubbaChat is required to:

Refuse to host CSAM
Report suspected CSAM to the Australian Centre to Counter Child Exploitation (ACCCE)
Respond to eSafety Commissioner notices

Any suspected CSAM identified on the platform is subject to immediate removal from serving, preservation of evidence, and mandatory reporting to the ACCCE at accce.gov.au/report. Account suspension follows immediately. BubbaChat cooperates fully with law enforcement.

8. Online Safety Act 2021 compliance

BubbaChat is a user-generated content service within the meaning of the Online Safety Act 2021 (Cth). We are committed to meeting our obligations under that Act, including taking reasonable steps to remove material that is harmful to Australians and responding to notices from the eSafety Commissioner.

If you wish to make a complaint about content on BubbaChat and you have not received a satisfactory response from us, you may contact the eSafety Commissioner at esafety.gov.au.
